ADVERSE LICENSING ACTIONS - 2002ANDERSON, David E., M.D.: License # 007476; 02/12/02. In lieu of proceeding to an Adjudicatory Hearing and in order to resolve all pending matters, the licensee agrees to voluntarily surrender his license to practice medicine in the State of Maine. The licensee agrees not to apply for reinstatement of his license in the State of Maine. This action is based on unprofessional conduct, incompetence and violation of Chapter 10 Rules of the Board of Licensure in Medicine proscribing sexual contact between a physician and a patient. ANDERSON, David E., M.D.: License # 007476; 01/08/02. Suspension of license due to unprofessional conduct, incompetence and violation of Chapter 10 Rules of the Board of Licensure in Medicine proscribing sexual contact between a physician and a patient. BARTLETT, ELIZABETH L., M.D.: License # 013352; 9/10/02. In lieu of proceeding to an Adjudicatory Hearing, the licensee agrees that the status of the licensee's medical license will be changed from Active to Inactive on the effective date of this agreement. If the licensee applies for reinstatement to Active status, she must document six (6) months of continuous sobriety through participation in the Physician's Health Program. This action is based on substance abuse issues. BREER, David N. M.D. License #: 013353. 11/12/02. In lieu of proceeding to an Adjudicatory Hearing, the licensee agrees that the status of his medical license will be changed from Active to Inactive on the effective date of this agreement. If the licensee applies for reinstatement to Active status, he must document six (6) months of continuous sobriety through participation in the Physicians' Health Program. This action is based on unprofessional conduct and substance abuse issues. CHAGRASULIS, Robert W. M.D. License # 012162; 12/3/02. The Board will reinstate the Maine medical license of the licensee with conditions. The licensee agrees to completely abstain from the use of any prohibited substances as outlined in the Consent Agreement. The licensee shall be subject to urine monitoring. The licensee agrees to attend AA and/or NA meetings a minimum of three times each week for one year from the effective date of this agreement and at least once each week through four years thereafter. This action is based on substance abuse issues. CLEMETSON, CHARLES D., M.D.: License # 013808; 9/10/02. In lieu of continuing with the Adjudicatory Hearing which began on July 9, 2002, the licensee agrees that the summary suspension ordered by the Board is terminated, and the status of the licensee's medical license will be changed from Active to Inactive on the effective date of this agreement. If the licensee applies for reinstatement to Active status, he must undergo an inpatient substance abuse evaluation and follow the recommendations and treatments suggested by the facility. This action is based on substance abuse issues and failure to comply with a Board Order regarding office management practices. CLEMETSON, CHARLES D., M.D.; License # 013808: 5/14/02. License suspension due to unprofessional conduct and incompetence based on habitual substance abuse and diagnosis of a mental or physical condition that may result in the licensee performing services in a manner that endangers the health or safety of patients. DEFANTI, THOMAS R. M.D.: License # 011764; 06/11/02. In lieu of proceeding to an Adjudicatory Hearing, the licensee agrees to accept a reprimand from the Board. In addition, he will arrange for monitoring of his laparoscopic procedures and provide the Board with relevant information regarding any complications. The licensee agrees to substance abuse monitoring and agrees to attend counseling sessions for substance abuse issues. This action is based on unprofessional conduct and substance abuse issues. FUHRMANN, Calvin F., M.D.: License # 014675; 02/12/02. In lieu of proceeding to an Adjudicatory Hearing, the licensee agrees to accept a Warning from the Board. This action was based on unprofessional conduct. GILLIAM, RICHARD L., M.D.: License # 010443; 9/10/02. In lieu of proceeding to an Adjudicatory Hearing, the licensee agrees to withdraw his application for renewal of an Active status medical license and request renewal of his medical license in Inactive status. This action is based on competency issues. LOISELLE, ANDRE B., M.D.: License # 011663; 11/12/02. At the conclusion of an Adjudicatory Hearing held on November 12, 2002 the Board voted to continue the suspension of the licensee's license for six (6) months. The licensee will appear before the Board on May 13, 2003. During the suspension of his license, the licensee will continue to provide supervised, visualized urine samples on a weekly basis. If there is any failure to maintain the mandated sampling schedule or if any specimen tests positive, after utilizing the process for confirmation, Dr. Loiselle's license to practice medicine in Maine shall be revoked. This action is based on a violation of the terms of a Consent Agreement. LOISELLE, ANDRE B., M.D.: License # 011663; 10/30/02. Automatic suspension for failure to maintain the mandated sampling schedule and provide urine samples, pursuant to the Consent Agreement effective January 8, 2002. LOISELLE, ANDRE B., M.D.: License # 011663; 01/08/02. In lieu of proceeding to an Adjudicatory Hearing, the licensee agrees to accept a reprimand from the Board. In addition, the licensee will be subject to substance abuse monitoring. SCULLION, DAVID F. M.D.: License # 010513; 01/08/02. Licensee complied with the terms of his Consent Agreement, which was effective 8/16/95. Restrictions and conditions on licensee's Maine medical license are removed effective 1/8/02. STOJANOV, IGOR M.D.: License # 014796; 5/14/02. At the conclusion of an Adjudicatory Hearing held on May 14, 2002 the Board voted to grant the licensee a renewal of his Maine medical license with the following conditions: the licensee shall receive counseling in either Georgia or Maine to begin no later that August 1, 2002 by a counselor pre-approved by the Maine Board; the counselor shall submit quarterly reports to the Maine Board; in the event that counseling is not completed to the satisfaction of the Maine Board within one year from the date of this license renewal, a rehearing may be scheduled and further sanctions, including license denial, may result; the licensee shall have a chaperone present for all examinations of female patients. TOTO, TIMOTHY, P.A.: License # PA-351; 04/11/02. The licensee's thirty (30) day license suspension, effective March 12, 2002, ended April 11, 2002. His license will be placed on probation until October 30, 2002 when his probation for his criminal conviction ends. This action is based on unprofessional conduct. TOTO, TIMOTHY, P.A.: License # PA-351; 03/12/02. In lieu of proceeding to an Adjudicatory Hearing, the licensee admits that writing prescriptions on Cumberland County Jail prescription pads for individuals who were not inmates or patients of the licensee constitutes unprofessional conduct. The writing of these prescriptions was outside of the licensee's plan of supervision and without the knowledge or approval of his supervising physician. The licensee's license to practice as a physician's assistant will be suspended for 30 days and his license will be placed on probation until October 30, 2002, when his probation for his criminal conviction ends. VIOLETTE, E. JEFFREY, M.D.: License # 012065; 12/10/02. By Decision and Order of the Board dated 7/19/01 the Board suspended the Maine medical license of the licensee for 360 days. On July 9, 2002 the licensee appeared before the Board and agreed to provide the Board with specific information before his license would be reinstated to active status. The licensee agreed that his license status would remain Inactive pending reinstatement. On July 30, 2002 the Board received a urinalysis report which was positive for marijuana. The licensee agrees that his license status will remain Inactive. The licensee will appear before the Board on March 11, 2003 to discuss compliance with this agreement and conditions for reinstatement of his medical license to Active status. WEINBERG, Benjamin L., M.D.: License # 015796; 1/28/02. By Consent Agreement, a medical license was issued subject to the following conditions: If the licensee fails to comply with any obligation in the contract with the New Hampshire Medical Society's Physicians' Health Program, that failure will constitute a violation of this Consent Agreement, which may result in the immediate suspension of the licensee's Maine medical license. If the licensee practices medicine in the State of Maine, he shall contract with the Physicians' Health Program in the State of Maine and participate in monthly random testing. This action is based on discipline by other state medical boards due to chemical dependency issues. WILSON, JAMES E., P.A.-C: License # PA-684; 7/9/02. At the conclusion of an Adjudicatory Hearing held on July 9, 2002 the Board voted to reinstate the Physician Assistant’s license with conditions related to substance abuse treatment. The licensee shall adhere to the Physicians’ Health Program contract. The licensee shall provide a letter from his treating physician which explains in detail his hypertension, sodium and water-loading problems. The licensee shall test his urine with creatinine strips prior to giving a test urine sample and, if the test registers low, he will remain on site and give a urine sample visually observed by a monitor until the creatinine is within the acceptable range. The licensee shall inform the Board of his home address and the name, address and phone number of any future employer. He shall notify the Board if he leaves the State of Maine so that arrangements may be made for appropriate testing. This action is based on substance abuse issues and violation of a prior consent agreement. WILSON, James E., P.A.-C: License # PA-684; 02/12/02. At the conclusion of an Adjudicatory Hearing held on February 12, 2002 the Maine Board of Licensure in Medicine voted to continue a suspension of the licensee's license for six months. In addition, the licensee will participate in substance abuse and psychiatric counseling. The licensee must report back to the Board at the end of the six-month suspension, at which time the Board will review his progress. This action is based on four (4) positive test results while under Consent Agreement for substance abuse monitoring. WILSON, JAMES E., P.A.-C: License # PA-684; 01/07/02. Automatic suspension for positive test result while under a Consent Agreement for substance abuse monitoring. WROBLESKI, WALTER J., M.D.: License # 012606; 10/8/02. In lieu of proceeding to an Adjudicatory Hearing, the licensee agrees to voluntarily surrender his Maine medical license as of the effective date of this agreement. He will not practice medicine in Maine or elsewhere until his Maine license is reinstated with or without conditions. Before the Board will consider reinstating the licensee's license, he must document six months of monitored sobriety through participation in the Physicians’ Health Program. In addition, the licensee must continue psychotherapy with his treating psychiatrist or other therapist as approved by the Board. The licensee will have all of his pain medication prescriptions written by his primary care physician and his psychiatric medications written by his treating psychiatrist. He will fill all of his prescriptions at one pharmacy. This action is based on unprofessional conduct and substance abuse issues.
