SECTION 3: CONSTRUCTION OF 32 M.R.S.A. SECTION 3275(l).

With regard to the "written examination" specified in the first sentence of 32 M.R.S.A. SECTION 3275(l), that examination shall refer to the Special Purpose Examination (SPEX) administered by the Federation of State Medical Boards and to such other examinations which the Board deems probative of a physician's competency. The Board may require an applicant to take the SPEX, at the applicant's cost, as one criterion to assist the Board in determining the competency of an applicant licensee or registrant. A passing score on the SPEX shall be as determined by the Federation of State Medical Boards. The Board herein recognized that the passage of the SPEX is not determinative of the competency of a physician; however, failure to pass the SPEX may be grounds to find a physician incompetent to practice medicine.
